How Do Wrongful Death Claims Work After a Fatal Crash in Salt Lake City, UT?

After a fatal crash in Salt Lake City, a wrongful death claim lets the family seek compensation from the party responsible. The claim usually goes through the at-fault driver's insurer and ends in a settlement or a lawsuit.

Under Utah law, the person's close relatives bring the claim, or the estate's personal representative brings it on their behalf. These relatives can include a surviving spouse, children, and parents.

Before the claim is resolved, the person's own auto policy may pay limited personal injury protection benefits. This coverage can help with funeral costs and some survivor losses, no matter who caused the crash.

Depending on the family's losses, relatives may recover money from the responsible party for lost financial support and household help. They may also recover for the loss of the person's love, companionship, and guidance.

Beyond the wrongful death claim, the estate may bring a survival claim for losses the person had before death. These can include medical bills from emergency care and wages lost between the crash and the death.

For wrongful death claims, families generally have two years from the date of death to file a lawsuit in Utah. Missing that deadline can prevent the claim from moving forward.

Because Utah law sets a filing deadline, a Salt Lake City wrongful death attorney can confirm how much time your family has and prepare the case. An attorney can also negotiate with the insurers and file a lawsuit if settlement talks fail.
