How Utah Law Treats Drivers and Bicyclists in South Salt Lake, UT
Bicyclists and drivers share busy streets in South Salt Lake, and both are expected to follow the same traffic rules. Utah law generally treats a person riding a bicycle on a roadway as having the same rights and duties as a driver. That also means drivers owe bicyclists ordinary care, such as watching for them before they turn or change lanes.
Utah also has a passing rule. Under this rule, drivers that overtake a bicycle generally must leave a safe distance, which is set to be a minimum of three feet. A driver who breaks a traffic rule like this may be found negligent, since a violation can be used as evidence in a claim.
Fault in bicycle cases tends to be disputed, so details like lighting, lane position and signaling can matter. Utah generally allows four years to file a personal injury lawsuit, and a person found 50 percent or more at fault is barred from recovering under the state's comparative fault statute. A personal injury lawyer can help weigh how these rules apply to a specific claim and gather the evidence that supports it.
