What Legal Options Are Available After a Truck Accident in Sardine Canyon, UT?
People injured in a collision involving a commercial truck may have legal options for seeking compensation if another party’s negligence contributed to the crash. Depending on the circumstances, a claim may involve the truck driver, the trucking company, another motorist, or multiple parties.
Utah follows a modified comparative fault system. An injured person may recover damages if their fault is not greater than the combined fault of the parties they are seeking compensation from and their fault is less than 50%.
Any compensation may be reduced according to their share of responsibility. Determining fault in a truck accident can require reviewing driver statements, witness accounts, photographs, vehicle damage, and available electronic records.
Compensation may cover medical expenses, future treatment, lost wages, reduced earning capacity, and pain and suffering, depending on the facts and applicable law. Someone with injuries may face ongoing treatment and rehabilitation, making it important to document both current expenses and anticipated future needs.
Utah generally allows four years to file a personal injury lawsuit, although specific circumstances can affect the deadline. Different rules may apply to claims involving government entities or other exceptional situations. Consulting a qualified attorney can help clarify the applicable time limits and potential sources of recovery.
