What Happens if the At-Fault Driver Has Too Little Insurance in Washington, UT?
In Utah, underinsured motorist coverage, typically called UIM, can help when the at-fault driver's insurance isn't enough to cover the full cost of an injury.
It comes from the claimant's own policy and can pay for medical bills, lost wages, and pain and suffering beyond the other driver's limits. Uninsured motorist coverage works in a similar way when the other driver has no insurance at all.
Utah's minimum liability limits are $25,000 per person and $65,000 per accident for bodily injury, which can run out quickly after a hospital stay or surgery.
Utah insurers must include UM and UIM coverage at the same limits as the policy's liability coverage unless the policyholder signs a written waiver choosing less. Many people find out only after an injury that they lowered or declined this coverage years earlier.
UIM claims also involve their own steps. The claimant usually has to resolve the claim against the at-fault driver's insurer first and keep their own insurer informed along the way.
To make the process easier, a car accident lawyer can review every policy that may apply, confirm whether UIM limits were ever reduced, and coordinate the claims so one settlement does not affect the other.
