Does Utah's No-Fault Law Limit Injury Lawsuits in St. George, UT?
Yes, to a point. Utah is a no-fault state, so your own personal injury protection pays the first $3,000 of medical bills, plus part of your lost wages, no matter who was at fault.
You can step outside that system and sue the at-fault driver for pain and suffering only if your medical bills top $3,000 or your injury fits certain serious categories.
Those serious categories include a broken bone, permanent disfigurement, permanent disability or impairment, loss of a body part, and death. Meeting any one of them is enough.
Below the threshold, a claim generally stays within PIP. Damage to your vehicle is handled separately, and you can claim it from the at-fault driver either way.
The $3,000 figure is reached through reasonable medical expenses, so getting treatment promptly and keeping complete records matter. ER visits, imaging and physical therapy can pass that mark quickly, but gaps in treatment give insurers room to question whether the care was needed.
A car accident lawyer can review bills and records to confirm whether the threshold has been met. The lawyer can then pursue a claim against the at-fault driver within Utah's four-year deadline for injury cases.
