How Utah's No-Fault Insurance Works for Drivers in Washington, UT
Utah is a no-fault state, so drivers usually turn to their own insurance first after an injury on the road. Every Utah auto policy must include at least $3,000 in personal injury protection, or PIP. This coverage helps pay medical bills, part of lost wages, and some other costs, no matter who was at fault.
That $3,000 figure matters for another reason. In Utah, a person generally can't sue the other driver for pain and suffering unless their medical bills top $3,000 or they have a serious injury.
That includes a broken bone, permanent disfigurement, a permanent disability, or the loss of a body part. Many people with soft tissue injuries never reach that line, so PIP may be the only money available to them.
$3,000 can run out fast, so keeping track of every bill matters. Drivers may want to check whether their policy carries more than the minimum PIP, since many insurers offer higher limits.
Gaps in treatment or missing records can make it harder to show that medical costs crossed the threshold. A car accident lawyer can review medical bills, confirm whether an injured driver has passed the $3,000 mark, and explain when a claim against the other driver's insurance may be possible.
