What Gunlock, UT Drivers Should Know About Utah's No-Fault Insurance Rules
Utah is a no-fault state, which means drivers generally turn to their own Personal Injury Protection, or PIP, coverage to pay initial medical bills after a wreck, regardless of who caused it. Utah law requires drivers to carry a minimum amount of PIP coverage.
Utah's no-fault system also includes a threshold that must be met before an injured person can step outside their own PIP coverage and pursue a claim against another driver for pain and suffering.
This threshold is typically based on the type of injury or the amount of medical expenses involved. Rollover crashes can result in injuries serious enough to meet that threshold, but confirming eligibility usually requires a close review of medical records and treatment costs.
Utah follows a modified comparative negligence rule, in which fault percentages can still affect a claim once it goes beyond PIP coverage. A car accident lawyer can help determine whether a case meets the threshold to pursue additional compensation and can assist with gathering the documentation insurers require.
