Workers' Compensation and Third-Party Claims After Construction Deaths in Iron County, UT
Utah's workers' compensation system generally serves as the exclusive remedy against an employer when a worker dies on the job. The benefits can include funeral and burial expenses and payments to qualifying dependents, and they typically do not depend on who was at fault. That no-fault structure is why many families assume workers' compensation is their only option.
However, it is not always the only option. Utah law may allow a separate wrongful death claim by the worker's heirs or personal representative when someone other than the employer may share responsibility. This third-party could be a contractor, a property owner, an equipment owner, or a manufacturer.
Damages in that kind of claim are different from workers' compensation benefits, and the filing period is generally two years. Which parties could be involved depends on the contracts and facts, so the answer varies from one job site to the next.
Construction work can involve several companies on one site, which can make responsibility harder to trace. Site safety logs, equipment maintenance records, subcontractor agreements, and witness accounts are all important to preserve in these kinds of cases.
In these situations, many families turn to a wrongful death lawyer to help them sort out which parties may be responsible, and how a workers' compensation claim and a third-party claim can proceed side by side.
