How Does Utah's No-Fault Insurance System Work in Hurricane, UT?
Utah uses a no-fault system, meaning a driver's own personal injury protection coverage generally pays an initial $3,000 in medical expenses after a traffic injury, no matter who caused it.
A person can usually pursue a claim against the at-fault driver only after meeting certain thresholds, such as medical expenses above $3,000 or certain serious injuries like permanent impairment. Because of that structure, the first insurance claim after an injury is usually made on one's own policy rather than the other driver's.
Personal injury protection benefits generally cover reasonable medical bills up to the policy's limit. Depending on the policy, they can also reach a portion of lost income, funeral costs, and certain household services.
Hospital bills can exceed that amount quickly, and once a threshold is met, a claim may be pursued against the at-fault driver's liability coverage. Medical payments coverage or health insurance may also apply, depending on the policies involved.
Drivers tend to deal with their own insurer and other driver's insurer at the same time, so tracking medical expenses from the first visit matters. Itemized bills, treatment notes, and records of any lasting limitation help show whether a threshold has been met.
A car accident lawyer can review those records, work out how much of the personal injury protection benefit has been used, and explain how a later claim against another driver's insurer may work.
