Who Can File a Wrongful Death Claim After a Crash in Utah?
In Utah, the surviving spouse, children, or parents of a person killed in a crash have the right to file a wrongful death claim. When a child loses their life in a collision the parents or legal guardians typically serve as the ones who bring the claim forward on behalf of their family. Utah law allows these claims when another party's negligence caused the death.
A wrongful death claim differs from a criminal case. It takes place in civil court and focuses on the financial and personal losses the family suffers as a result of losing their loved one. These losses can include funeral and burial expenses, the loss of the deceased person's future financial contributions to the family, and the loss of companionship and guidance.
Utah sets a two-year statute of limitations for wrongful death claims, meaning families generally have two years from the date of death to file. Missing this deadline can permanently bar a family from seeking any compensation through the courts.
In crashes involving commercial vehicles like semi trucks identifying all liable parties takes time. Semi trucks operate under federal and state trucking regulations. Acting early gives a wrongful death attorney the opportunity to preserve critical evidence, including the truck's black box data, driver logs, and maintenance records.
Semi truck crashes at busy intersections like Pony Express Road and Mountain View Corridor often involve multiple layers of liability. The truck driver, the trucking company, and potentially other parties may each bear some responsibility depending on the circumstances. An attorney can investigate the crash thoroughly and explain who may be held accountable.
