Rights of Injured Passengers in Motorcycle Accidents in Cedar City, UT
A passenger riding along on a motorcycle generally has a more straightforward path to compensation than the operator, since a passenger typically isn't the one who can be blamed for causing a crash.
Passengers can suffer the same range of injuries as the operator, including road rash, fractures, or head trauma, but without wearing any protective gear beyond what they chose to bring along. Because Utah does not require helmets for adult riders, injuries can vary widely depending on what protective equipment, if any, was being used at the time of the crash.
If the motorcycle operator's own actions contributed to the crash, an injured passenger can generally still pursue a claim against that driver's insurance, separate from any claim involving another vehicle. A motorcycle accident lawyer can help a passenger determine which policies apply, particularly when it isn't yet clear whether the operator or another factor caused the bike to go down.
At Cutt, Kendell & Olson Attorneys at Law, we can help injured passengers understand what claims might be available under Utah law. Sorting out responsibility when someone else was operating the motorcycle takes a careful look at the facts, and our team can help with that process.
