Who Can File a Wrongful Death Claim After a Crash in West Jordan, UT?
Under Utah law, the spouse, children, or parents of a person killed in a West Jordan crash may file a wrongful death claim against the party responsible for the accident. If another driver's actions directly caused the fatal collision, surviving family members may have the right to seek compensation for their loss.
Losing a family member in a road accident brings significant financial and personal consequences. Families may face funeral costs, loss of income, and the long-term absence of a loved one's support. Utah law recognizes these losses and allows eligible family members to pursue a claim for damages that reflect the full impact of the death.
In a wrongful death case, an attorney can investigate the crash, gather evidence, and identify who may be liable. This can include reviewing police reports, witness statements, and any available traffic or surveillance footage.
Legal guidance helps families understand what the process looks like and what types of compensation may be available to them.
Many families are unsure whether they qualify to file a claim or how long they have to take action. In Utah, wrongful death claims are generally subject to a two-year statute of limitations from the date of the accident.
A consultation with a wrongful death attorney early helps ensure important deadlines are not missed and that evidence is preserved.
