How Long Do Families Have to File a Wrongful Death Claim in Hurricane, UT?

When a loved one dies in a crash in Hurricane, families have two years from the date of death to file a wrongful death claim in Utah. State law gives families time to grieve, gather records, and speak with an attorney about possible legal action.

If the claim involves a government vehicle or a city-owned roadway, the deadline may be shorter. Families may need to file a notice of claim within one year in those situations. Missing that deadline can affect the ability to pursue compensation.

In some cases, new evidence or delayed discovery of the cause of death may affect the filing timeline. A court may allow additional time if the family could not reasonably identify the responsible party earlier.

An attorney can review the circumstances and determine whether an exception may apply.

Before filing a wrongful death claim, families should collect documents connected to the crash and their loved one’s passing. Medical records, the official crash report, and a certified death certificate can help support the claim.

Funeral expenses, income records, and insurance correspondence may also become important during the process.

In a Hurricaine wrongful death case, surviving family members may seek compensation for funeral costs, lost financial support, and loss of companionship. A spouse, child, or parent of the deceased may have the right to pursue the claim. The damages available may depend on the facts surrounding the crash and the losses involved.

After a fatal pedestrian crash, insurance companies may contact families with settlement offers shortly after the incident. Early offers may not fully account for long-term financial and emotional losses.

A wrongful death attorney can help review evidence, identify liable parties, and communicate with insurance companies. Legal guidance can also help families understand what steps to take while managing the aftermath of a sudden loss.
