A jury has returned a unanimous $6.5 million verdict for a 38-year-old plaintiff who was seriously harmed during what should have been a routine brain tumor surgery. Partner Jacquelynn D. Carmichael represented the plaintiff at trial.
The plaintiff went in to have a non-malignant brain tumor removed. Instead, the neurosurgeon left the tumor in place and removed the plaintiff’s healthy pituitary gland. The pituitary gland regulates hormones the body depends on to function, and its loss left the plaintiff with significant, permanent disability and a lifelong need for medication to survive.
After hearing the evidence, the jury awarded $6.5 million, including:
- $1.2 million for the future cost of medication
- $1.3 million for past and future lost wages
- $4 million for non-economic damages, such as pain, suffering, and the lasting effect on the plaintiff’s life
